Terms & Conditions
1. Definitions
• “Contractor” refers to the building company or individual performing the works.
• “Customer” refers to the person or organisation commissioning the works.
• “Works” refers to the services, labour, and materials described in the estimate or contract.
• “Site” refers to the location where the works are to be performed.

2. Scope of Works
2.1 The Contractor will carry out the Works as set out in the written estimate or schedule.
2.2 Any changes or additional work must be agreed in writing and may incur additional charges.
2.3 The Contractor is not responsible for errors or omissions in plans supplied by the Customer.

3. Price & Payment
3.1 The total price is as stated in the estimate unless varied as per Clause 2. The estimate is valid for 14 days. Once accepted, due to increasing costs of materials, plant hire and labour, it may be necessary to re-visit the estimate to review prices supplied prior to commencing work.
3.2 Estimates do not include any costs relating to:
• Building control
• Decorating
• Floor and wall finishes
• Landscaping
• Connection to mains services (i.e. gas etc.)
• Amendments to consumer units and boilers
3.3 Payment terms will be set out as below:
3.3.1 A deposit of 10% will be required on acceptance of the estimate (BACS payment only).
3.3.2. An appropriate staged payment schedule will be calculated depending on the value of the project.
3.3.3 Upon completion and sign off final payment is due on receipt of invoice
3.4 Late payments may incur interest at a specified rate.
3.5 Materials remain the property of the Contractor until full payment is received.

4. Timing & Programme
4.1 The Contractor will use reasonable efforts to complete the Works within the estimated timeframe.
4.2 The Customer acknowledges that delays can occur due to weather, supply issues, or unforeseen conditions.
4.3 The Contractor is not liable for delays beyond their reasonable control.

5. Access & Site Conditions
5.1 The Customer must provide safe and uninterrupted access to the Site.
5.2 The Customer must ensure the Site is free from hazardous materials unless stated otherwise.
5.3 The Contractor may require access to electricity, water, and waste disposal.

6. Customer Responsibilities
6.1 Obtain necessary planning permissions and approvals unless agreed otherwise.
6.2 Notify neighbours or third parties if access across their land is required.
6.3 Remove personal belongings or other obstructions before work commences.

7. Variations & Additional Works
7.1 Any additional work not included in the original estimate will be charged at agreed rates.
7.2 Variations must be confirmed in writing before the Contractor proceeds.
7.3 Should the Customer choose to source your own materials after accepting the estimate or after work has commenced, it should be noted that:
• The Contractor will not be responsible for lead times, ordering, or delivery of Customer-supplied materials.
• Any suppliers or subcontractors engaged by the Customer and using the Contractors equipment or facilities will incur additional charges.
• A percentage fee, based on the original material costs, will still be applied to the Customer’s invoice.

8. Materials & Workmanship
8.1 All materials will be new and of suitable quality unless agreed otherwise.
8.2 Workmanship will be carried out with reasonable skill and care.
8.3 Where specific products or brands have been requested, availability may affect supply.

9. Warranties & Defects
9.1 The Contractor provides a defects-liability period (12 months) from completion.
9.2 The warranty does not cover:
• Damage caused by the Customer or others
• Normal wear and tear
• Issues caused by misuse or neglect
9.3 The Customer must notify defects in writing as soon as they are discovered.

10. Health & Safety
10.1 The Contractor will comply with applicable health and safety legislation.
10.2 The Customer must keep children, pets, and visitors clear of working areas.
10.3 The Contractor may stop work if safety is compromised.

11. Insurance
11.1 The Contractor will maintain public liability insurance.
11.2 The Customer is responsible for insuring the Site and their property during the Works.

12. Termination
12.1 Either party may terminate the contract if the other party commits a material breach and fails to remedy it within a reasonable time.
12.2 The Contractor may suspend or terminate the Works if:
• Payments are not made
• Access to the Site is obstructed
• Safety risks are present

13. Liability
13.1 The Contractor is not liable for:
• Existing defects in the property
• Consequential or indirect losses
13.2 The Contractor’s liability is limited to the contract price except where prohibited by law.

14. Dispute Resolution
14.1 Should a dispute arise, both parties will attempt to resolve it amicably.
14.2 If unresolved, the matter may be referred to mediation or arbitration.
14.3 Nothing prevents either party from pursuing legal action if necessary.
